1. Introduction

Welcome to the Classroom platform operated by CWA / Wizards Learning Hub ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our educational platform at wizardslearninghub.co.nz.

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the platform. If you are a parent or guardian registering a child, you agree to these Terms on behalf of your child.

2. Definitions

  • "Platform" refers to the Classroom web application and all associated services.
  • "User" refers to any person who accesses or uses the platform, including students, parents, teachers, and administrators.
  • "School" refers to an educational institution registered on the platform.
  • "Content" refers to all educational materials, quizzes, resources, and data available on the platform.
  • "Account" refers to a registered user profile on the platform.

3. Eligibility

  • The platform is designed for students in Year 1-9 and their parents, teachers, and school administrators.
  • Student accounts must be created by a parent, teacher, or school administrator.
  • Users under the age of 16 must have consent from a parent or guardian to use the platform.
  • By registering, you confirm that the information you provide is accurate and complete.

4. User Accounts

4.1 Account Creation

Accounts are created by authorised personnel such as school administrators, teachers, or parents. Each user is assigned a role (e.g., student, parent, teacher, administrator) that determines their access level.

4.2 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately of any unauthorised use of your account.
  • We are not liable for any loss arising from unauthorised use of your account.
  • Sharing account credentials with others is prohibited.

4.3 Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, engage in inappropriate behaviour, or at the request of a school administrator.

5. Acceptable Use

When using the platform, you agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the platform
  • Interfere with or disrupt the platform's functionality
  • Upload malicious software or harmful content
  • Impersonate another user or misrepresent your identity
  • Harass, bully, or intimidate other users
  • Copy, distribute, or modify platform content without permission
  • Use automated tools to scrape or extract data from the platform
  • Share confidential student or school information with unauthorised parties

6. Educational Content

All educational content on the platform, including but not limited to quizzes, lessons, and learning materials, is provided for educational purposes only.

  • Content is aligned with the New Zealand curriculum where applicable.
  • We strive to ensure content accuracy but do not guarantee it is error-free.
  • Content may be updated, modified, or removed at any time.
  • Educational materials remain the intellectual property of CWA / Wizards Learning Hub.

7. Billing and Payments

  • Certain features of the platform may require payment.
  • Payments are processed securely through Stripe.
  • All fees are quoted in US Dollars (USD) unless otherwise stated.
  • Schools are responsible for managing their billing and invoicing through the platform.
  • Refund requests are handled on a case-by-case basis. Please contact us for refund enquiries.
  • We reserve the right to change pricing with reasonable notice to affected users.

8. Intellectual Property

All intellectual property rights in the platform, including its design, code, content, logos, and branding, are owned by CWA / Wizards Learning Hub.

  • You may not reproduce, distribute, or create derivative works from our content without written permission.
  • The "CWA / Wizards Learning Hub" and "Classroom" names and logos are our trademarks.
  • User-generated content (e.g., quiz responses) remains the property of the respective user or school.

9. Privacy

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the platform, you consent to our data practices as described in the Privacy Policy.

10. Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by New Zealand law, we disclaim all warranties, whether express or implied, including:

  • Fitness for a particular purpose
  • Uninterrupted or error-free operation
  • Accuracy or completeness of content
  • Security against all potential threats

11. Limitation of Liability

To the maximum extent permitted by the New Zealand Consumer Guarantees Act 1993 and other applicable law:

  • We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.
  • Our total liability shall not exceed the amount paid by you (or your school) to us in the 12 months preceding the claim.
  • We are not liable for any loss of data, interruption of service, or third-party actions.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under New Zealand law, including under the Consumer Guarantees Act 1993.

12. Indemnification

You agree to indemnify and hold harmless CWA / Wizards Learning Hub, its directors, employees, and agents from any claims, losses, or damages arising from your breach of these Terms or misuse of the platform.

13. Termination

  • You may stop using the platform at any time.
  • We may suspend or terminate your access for violations of these Terms.
  • Schools may request account termination for their staff and students.
  • Upon termination, your right to use the platform ceases immediately.
  • We may retain certain data as required by law or for legitimate business purposes.

14. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on the platform with a revised "Last updated" date. Continued use of the platform after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the New Zealand courts.
